Cairo, February 10th, 2026<\/strong><\/p>\n

The Refugee Platform in Egypt expresses its deep sorrow and anger at the death of Sudanese asylum seeker Mubarak Qamar al-Din Majzoub Abdullah, 67, inside the al-Shorouk police station in Cairo governorate at dawn on Thursday, February 5th, 2026. Mubarak was found dead nine days after his detention began; as an expansive security campaign targeting refugees, asylum seekers, and migrants in Egypt rages on over the past few months after intensifying at the beginning of this year.<\/span><\/p>\n

The platform affirms that Mubarak, an elderly person who was an asylum seeker registered with the United Nations High Commissioner for Refugees, dying inside an official place of detention constitutes a grave violation of the right to life and physical integrity and epitomizes a breach of Egypt’s constitutional obligations under Article 55; which stipulates that \u2018anyone who is arrested, detained, or whose freedom is restricted must be treated in a manner that preserves their dignity. They must not be tortured, intimidated, coerced, or physically or mentally harmed, and their detention or imprisonment must only be in places designated for that purpose that are humane and sanitary\u2019.\u00a0<\/span><\/p>\n

Furthermore, this incident also constitutes a violation of Egypt’s international obligations to treat all people deprived of their liberty in a humane manner that preserves their dignity. This makes the incident fraught with a series of grave violations of Egypt’s constitutional, legal, and international obligations. In light of the current facts, this incident warrants an urgent and transparent investigation, the evidence and context of which must be disclosed to the public and forcibly displaced communities.<\/span><\/p>\n

The late Mubarak Qamar al-Din Majzoub Abdullah was born in Khartoum in January 1959 and held a valid asylum seeker card issued by the United Nations High Commissioner for Refugees in Egypt in October 2025, expiring in April 2027. This gave Mubarak clear legal status as an asylum seeker subject to international protection, prohibiting his arbitrary arrest or detention solely on the basis of his status as a refugee in accordance with the rules of the Foreigners’ Asylum Law 164 of 2024, the principle of non-refoulement, and the prohibition of discrimination.<\/span><\/p>\n

According to documentation belonging to the Refugee Platform in Egypt, Mubarak was arrested on January 26th, 2026, while shopping for household supplies, a recurring pattern when targeting forcibly displaced people, without any explanation or legal justification for his arrest. This alone constitutes a clear violation of Article 54 of the Egyptian Constitution, which requires a court order to restrict freedom; informing the person of the reasons for their arrest; and allowing them to contact their family and lawyer immediately.<\/span><\/p>\n

The Refugee Platform in Egypt has analyzed documents and testimonies indicating that Mubarak was arrested while carrying proof that he had applied for a residence permit, including a reference number from the Foreign Affairs Ministry and a specific date for obtaining the permit on September 2nd, 2027. This also negates any legal justification for treating Mubarak as a \u2018person in violation of residency requirements\u2019 or targeting him because of Mubarak\u2019s administrative status.<\/span><\/p>\n

According to corroborating testimonies documented by the Refugee Platform in Egypt, asylum seeker Mubarak Qamar al-Din Majzoub Abdullah was detained at the al-Shorouk Police Station in inhumane conditions that included severe overcrowding, a lack of adequate sleeping space, and poor ventilation. Moreover, Mubarak was denied immediate and regular medical care, in the same way other detained people were routinely denied medical care, despite glaring signs of deterioration in Mubarak\u2019s health during his nine-day-long detention. The testimonies also indicate that Mubarak\u2019s family was not immediately notified of the deterioration in Mubarak\u2019s health, and were not given any opportunity to inquire regarding Mubarak\u2019s health circumstances; monitor his health condition; or transfer Mubarak in a timely manner to an appropriate hospital. This confirms gross negligence; in a clear violation of Articles 7 and 10 of the International Covenant on Civil and Political Rights, which prohibit cruel and inhuman treatment and oblige the state to treat all people deprived of their liberty humanely and with respect for their dignity.\u00a0<\/span><\/p>\n

This incident cannot be viewed as an isolated one, as it takes place in the wake of a broader policy pursued by the Egyptian government against forcibly displaced people, documented by the Refugee Platform in Egypt in our report \u2018No Safe Haven: Unprecedented Security Crackdown<\/span><\/p>\n

Against Forcibly Displaced People Residing in Egypt\u2019. This report documents a widespread campaign of arresting and detaining forcibly displaced people, including those who were already granted formal refugee status through the issuance of asylum cards or residence permits pending renewal. Additionally, the report also highlights the inhumane conditions of detention, which include a lack of medical care that risks exposing dependent groups like the elderly to mortal danger. The content of this report is consistent with the findings of another joint report published by the platform in partnership with the Egyptian Initiative for Personal Rights (EIPR), titled \u2018The Collapse of Egypt’s Protection for Refugees\u2019, that documented the breakdown of the refugee protection system; the increase in arbitrary arrests and detentions; and the disregard for the principle of non-refoulement as well as the fundamental guarantees of the right to liberty and life. The joint report also emphasized the failure and obstruction of the UNHCR in carrying out its own mandatory protection duties amid the aforementioned developments, as well as the UNHCR\u2019s silence in the face of clear violations of asylum law and in blatant breach of the organization\u2019s own mandate.<\/span><\/p>\n

The Refugee Platform in Egypt recalls that the death of asylum seeker Mubarak Qamar al-Din Majzoub Abdullah is not the first case in which a forcibly displaced Sudanese citizen has lost his life in Egyptian detention centers and facilities under harsh conditions and gross medical negligence. It will not be the last incident either if Egyptian authorities continue to pursue the same illegal policies. In August 2025, the platform documented the death of forcibly displaced Sudanese citizen Mujahid Adel Mohamed Ahmed inside the Third District of October 6th City\u2019s Police Station (Al-Ahram Station) in Giza Governorate, after Mujahid was detained for 21 days in inhumane conditions and denied necessary medical care despite suffering from diabetic complications. This was due to Mujahid\u2019s arbitrary arrest on the grounds that Mujahid did not have a valid residence permit. The platform has also documented at least one other death in detention facilities in the city of Aswan.<\/span><\/p>\n

Based on the aforementioned incidents, the Refugee Platform in Egypt affirms that the Public Prosecution\u2019s Office, as the authority responsible for initiating criminal proceedings and monitoring places of detention, must act immediately and without delay based on the office\u2019s responsibility to enforce the constitution, the law, and the international conventions to which Egypt is a party. Furthermore, the Public Prosecution\u2019s Office must open a detailed, thorough, extensive, independent, and transparent criminal investigation into the death of asylum seeker Mubarak Qamar al-Din Majzoub Abdullah inside al-Shorouk Police Station. <\/span>This investigation must include, in particular:<\/b><\/p>\n

    \n
  1. The legal basis for Mubarak\u2019s arrest and a statement on the extent to which the arresting authority complied with the provisions of Article 54 of the Constitution and Articles 37, 38, and 41 of the Code of Criminal Procedure regarding the necessity of a reasoned judicial order, and respect for the guarantees of notification and access to a lawyer and family members.<\/span><\/li>\n
  2. The legality of Mubarak\u2019s continued detention throughout this period and the extent to which the conditions and controls of preventive detention or any other form of restriction of liberty are met, in light of the constitutional rule that personal liberty is a natural right and that the presumption of innocence is fundamental to human beings and that any restriction thereof is an exception that must be interpreted narrowly.<\/span><\/li>\n
  3. The reality of the medical neglect Mubarak had suffered, and an assessment of the physical and health conditions of detention in accordance with the standard of \u2018humane treatment and respect for dignity\u2019 contained in Article 10 of the International Covenant on Civil and Political Rights and the provisions of the Constitution in Chapter III on rights, freedoms, and public duties that prohibit torture, intimidation, or treatment that undermines dignity.<\/span><\/li>\n
  4. Determine criminal and administrative responsibility for any negligence or violation, and take the necessary disciplinary and criminal measures against anyone proven to be involved in negligence, mistreatment, obstruction of medical care, or concealment of information from Mubarak\u2019s family.<\/span><\/li>\n<\/ol>\n

    The platform also calls on the Egyptian Public Prosecutor’s Office to open an independent and urgent investigation into the violations attributed to the Interior Ministry, against the backdrop of arbitrary detention campaigns and random arrests targeting forcibly displaced people.<\/span><\/p>\n

    The testimonies reviewed by the platform indicate that organized security campaigns targeted forcibly displaced communities\u2019 gathering spaces, resulting in the arrest of dozens of people, particularly forcibly displaced Sudanese and Syrian citizens, including individuals registered with the United Nations High Commissioner for Refugees.<\/span><\/p>\n

    These practices constitute a serious violation of the right to liberty and security of person guaranteed by Articles 54 and 55 of the Egyptian Constitution and Articles 9 and 14 of the International Covenant on Civil and Political Rights, as well as Egypt’s obligations under Asylum Law No. 164 of 2024 and the principle of non-refoulement specifically with regard to forcibly displaced people fleeing from areas of destabilizing violence.<\/span><\/p>\n

    The platform emphasizes that the role of the Public Prosecutor’s Office is not limited to investigating the circumstances of Mubarak\u2019s death, but extends by law to monitoring the implementation of release decisions issued in favor of refugees, asylum seekers, and migrants who were arbitrarily detained while ensuring the immediate release of all those for whom release decisions were already issued, including:<\/span><\/p>\n

      \n
    • Review the status of all forcibly displaced people currently detained in police stations and non-designated detention facilities, ensure that there is a clear and specific legal basis for their detention and that this basis is consistent with the rules on pretrial detention set out in the Constitution and the Code of Criminal Procedure.<\/span><\/li>\n
    • Order the immediate release of anyone who was detained solely because of their refugee, migrant, asylum seeker, or administrative residence status without a serious criminal charge or enforceable court ruling, in accordance with the constitutional principle that personal freedom is the norm and any restriction imposed on normalized personal freedom is an exception that must be justified by the courts.<\/span><\/li>\n
    • Require law enforcement agencies to implement release decisions issued by the prosecution or the judiciary without delay or procrastination, and immediately investigate any official who refuses or fails to implement these decisions, as this constitutes a crime punishable by law and undermines the principle of the rule of law and the separation of powers.<\/span><\/li>\n
    • Enable lawyers and families of detained people to access their clients and relatives; obtain accurate and up-to-date information about their places of detention, and ensure that they are not transferred or concealed in a manner that impedes legal and judicial oversight in accordance with fair trial guarantees and the right to defense.<\/span><\/li>\n
    • Ensure that detained people and their families have fair access to litigation procedures for any administrative decisions issued against them without restriction or threat.<\/span><\/li>\n<\/ul>\n

      We also call on the United Nations High Commissioner for Refugees to exercise its role in protecting and caring for refugees and asylum seekers registered with the UNHCR by providing them with legal support, and ensuring that all those who hold formal status are shielded by UNHCR legal protection.<\/span><\/p>\n

      The continued detention of forcibly displaced people outside the constitutional and legal framework and the deterioration of detention conditions, as documented in human rights reports, transform detention facilities into environments that pose a high risk to physical as well as psychological wellbeing and mortality. Every day that arbitrarily detained people spend in detention facilities threatens their health and lives; leading to more unnecessary deaths and irreparable harm while directly violating Article 6 of the International Covenant on Civil and Political Rights and Egypt’s obligations to protect the right to life, in accordance with Article 18 of the Egyptian Constitution, which states that \u2018it is a crime to withhold treatment in its various forms from any person in cases of emergency or danger to life\u2019.\u00a0<\/span><\/p>\n

      Accordingly, the Refugee Platform in Egypt holds the Interior Ministry and other relevant security authorities legally and politically responsible for the safety of forcibly displaced people in detention facilities. Moreover, the platform holds the Public Prosecution\u2019s Office responsible for effectively monitoring these detention centres by ensuring that the implementation of release decisions and the investigation of any deaths or injuries that occur within these facilities are a constitutional and international obligation, and not discretionary options.<\/span><\/p>\n

      The platform calls on the Public Prosecutor’s Office to announce the results of the investigation into the death of asylum seeker Mubarak Qamar al-Din Majzoub Abdullah to the public, and to ensure that Mubarak\u2019s family and lawyers are involved in the proceedings to uncover the circumstances of Mubarak\u2019s arrest, detention, and death. Additionally, the platform calls for the provision of effective remedies, including compensation as well as genuine criminal and administrative accountability, in accordance with Egypt’s obligations under the Convention against Torture and the International Covenant on Civil and Political Rights to ensure justice and compensation for victims of grave human rights violations.<\/span><\/p>\n

      Furthermore, the platform calls for an immediate end to the ongoing security campaign against forcibly displaced people as well as a fundamental review of detention policies, in accordance with the Egyptian Constitution and international refugee and human rights law. The cessation of which would reaffirm that the protection of the life and dignity of every human being, including refugees, asylum seekers, and migrants, is a legal and moral obligation of the state that cannot be reneged upon.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
